Terms and Conditions

1. Agreement

These Terms and Conditions ("Terms") govern your access to and use of LaunchForge IQ websites, applications, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

LaunchForge IQ provides AI-assisted niche discovery and product research tools for Etsy sellers and similar creators. Features, limits, and availability may change as we improve the product. Some modules shown in the interface may be labeled "Soon" and are not yet part of the Service.

3. Accounts

You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms, create risk, or abuse the Service.

4. Plans, trials, and billing

  • The Free plan includes limited usage (for example capped niche runs and daily searches).
  • Starter and Pro subscriptions may include a 7-day free trial that requires a valid payment method. After the trial, your selected plan renews automatically at the then- current price unless you cancel before the trial ends.
  • Paid plans are billed in advance on a recurring basis through Stripe. Taxes may apply.
  • You can manage or cancel through the billing flows we provide. Cancellation stops future renewals; fees already charged are generally non-refundable except where required by law or expressly stated by us.
  • We may change prices or plan limits with notice. Continued use after the change takes effect constitutes acceptance.

5. Acceptable use

You agree not to:

  • Violate laws, Etsy policies, or third-party rights
  • Scrape, reverse engineer, or overload the Service beyond permitted API usage
  • Attempt to bypass plan limits, authentication, or security controls
  • Upload malware or interfere with other users
  • Misrepresent research outputs as guaranteed sales, revenue, or official Etsy advice
  • Use the Service to build a competing data product by systematically copying results

6. Marketplace and research outputs

Research results are informational estimates based on available marketplace signals and AI synthesis. LaunchForge IQ does not provide sales or revenue guarantees, financial advice, or official Etsy partnership endorsements. You remain solely responsible for product, pricing, listing, and business decisions.

7. Intellectual property

The Service, branding, software, and original content are owned by LaunchForge IQ or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. Feedback you provide may be used by us without obligation.

8. Third-party services

The Service depends on third parties such as Clerk, Stripe, hosting providers, AI model providers, and Etsy APIs. Their availability, policies, and outages are outside our control. Your use of those services may be subject to their terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESULTS WILL BE ACCURATE, COMPLETE, OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAUNCHFORGE IQ AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM.

11. Indemnification

You will defend and indemnify LaunchForge IQ against claims arising from your use of the Service, your listings or business practices, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access immediately for breach, non-payment, abuse, or risk to the Service. Provisions that by nature should survive (including intellectual property, disclaimers, liability limits, and indemnity) will survive termination.

13. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise. Courts located in Florida will have exclusive jurisdiction, except where prohibited.

14. Changes

We may update these Terms by posting a revised version with a new "Last updated" date. If changes are material, we will provide reasonable notice. Continued use after the effective date means you accept the updated Terms.
